my dad was fighting a medical negligence case, he was using legal aid, they legal aid said as his case didnt?

have much chance of success so they withdrew the funds, however his solicitor has since contacted him and told him the case has already started court proceeding's and my dad may be liable for the court costs if he looses...how does he stand legally, surely the solicitor should have anticipated this and my dad shouldn't be liable, can the solicitors be considered negligent?please help.
